No. The Marketplace-administration does keep score of how many downloads one person does, but (publicly) nothing more.
No. Whatever is downloaded is visible. I have not yet come across an app or widget that did not show the code. You can legally keep intellectual property of the actual code, but that won’t stop anyone from refactoring it.
